The short version. We run the software and keep it available and backed up. You keep ownership of everything you put in it, and you can take it out whenever you like. Either side can end the arrangement with notice.
They govern use of FacilityStream — the website, the application, and the public request portal. By creating an account or using the product, the organization doing so agrees to them. Where a signed agreement says something different, that agreement wins.
In these terms, “you” means the organization that holds the account, and “we” means the provider of FacilityStream.
Your data stays yours. Work orders, assets, photographs, people, history — all of it. Nothing here transfers ownership.
You grant us only the permission needed to run the service: to store it, back it up, display it to people you have authorized, and process it as the features you have switched on require. Nothing more.
We do not sell it, mine it for advertising, or use it to train models. The Privacy Policy sets out exactly what is done with it, including what leaves our systems and when.
You can export your data at any time while the account is live, and you are responsible for having the right to put into the system whatever you put into it.
Where a breach is serious or ongoing, we may suspend an account to protect other customers. We will tell you why, and we will restore it once it is resolved.
We aim to keep the service running and will give notice of planned maintenance where we reasonably can. We do not promise uninterrupted service: hosting fails, networks fail, and third parties we depend on have outages of their own.
Backups run daily. Backups are a recovery mechanism, not a guarantee against every kind of loss, and they do not replace your own export if your records matter to you.
The briefing and assistant features send information from your system to a third-party AI provider and show you what comes back. They are off until switched on.
AI output can be wrong. Treat it as a prompt to look at something, never as a decision. Do not rely on it for anything affecting safety, compliance or a person's employment without checking the underlying records yourself.
The service is provided as it is. To the extent the law allows, we exclude implied warranties and are not liable for indirect or consequential loss, lost profits, or lost data beyond what our backups hold.
Where liability cannot be excluded, it is limited to the fees you paid in the twelve months before the claim.
Nothing here limits liability for fraud, or for anything else the law does not permit to be limited.
We may update these terms. If a change materially affects you we will email current customers at least 30 days beforehand. Continuing to use the service after that is acceptance; if you would rather not, cancel and we will refund the unused part of the period.
These terms are governed by the laws of the State of Texas, United States, and the courts there have jurisdiction — without affecting any right you have to bring a claim where you live.
